Gainzville Training Club

1. Overview

These Terms of Service govern your use of the Gainzville Training Club website and the purchase of any digital training programs, downloadable content, online coaching services, or physical merchandise (“Products”).

By accessing this website or purchasing from Gainzville Training Club, you agree to be bound by these Terms.

If you do not agree, you must not use this website or purchase our Products.


2. Eligibility

You must be at least 18 years old, or have permission from a parent or legal guardian, to purchase or use our Products.

Minors & Parental Consent

If the purchaser or participant is under the age of 18, a parent or legal guardian must provide explicit consent prior to participation in any Gainzville Training Club products or services.

By purchasing or enrolling a minor in any program or coaching service, the parent or legal guardian:

  • Confirms they are the legal parent or guardian of the participant
  • Accepts full responsibility for the minor’s participation
  • Acknowledges the inherent risks associated with physical training
  • Confirms that the minor is medically fit to participate, or has been cleared by a qualified healthcare professional
  • Agrees to be the primary point of contact for communication and billing
  • Gainzville Training Club reserves the right to request written parental consent and may refuse or terminate access if appropriate consent is not provided.

3. Products & Services

Digital Products

We sell:

  • Downloadable PDF training programs
  • Training guidebooks
  • Tracking spreadsheets
  • Access to exercise demonstration videos

Once purchased, digital Products are delivered electronically.

Physical Products

We sell teamwear including t-shirts, singlets, and other apparel.

Online Coaching Services 

Gainzville Training Club offers 1:1 online coaching services, which may include:

  • Personalised training programs
  • Ongoing communication and support
  • Check-ins and progress reviews

Online coaching is educational and guidance-based only and does not replace professional medical advice.

Additional terms specific to online coaching apply, including payment, commitment length, cancellations, and liability.


4. Payments

All prices are listed in Australian Dollars (AUD) unless stated otherwise.

Payments are processed securely via third-party providers (e.g. Stripe, PayPal). We do not store your payment details.


5. Digital Product Access & No Refunds

Due to the nature of digital content:

  • All digital product sales are final
  • No refunds, exchanges, or cancellations once access or download has been provided

By purchasing, you acknowledge that you are receiving immediate access to intellectual property.

This does not affect your rights under Australian Consumer Law.


6. Merchandise Returns & Consumer Rights

Our returns and refunds for physical products are governed by Australian Consumer Law.

You are entitled to a replacement or refund if an item is:

  • Faulty
  • Damaged
  • Not as described

We do not offer refunds for:

  • Change of mind
  • Incorrect size selection (unless stated otherwise)
  • Normal wear and tear

7. Health & Fitness Disclaimer

Our Products are for educational purposes only.

  • We are not medical professionals
  • You should consult a qualified healthcare professional before beginning any exercise or nutrition program
  • Participation is at your own risk

Results vary between individuals, and we make no guarantees regarding outcomes.


8. Assumption of Risk

By using our training programs or coaching services, you acknowledge that physical training involves inherent risks including injury.

You voluntarily assume all risks associated with participation.


9. Intellectual Property

All content provided by Gainzville Training Club — including programs, videos, PDFs, spreadsheets, logos, branding, and written material — is protected by copyright.

You may not:

  • Share
  • Reproduce
  • Resell
  • Distribute without written permission.

10. Account Misuse & Termination

We reserve the right to suspend or terminate access if:

  • Content is shared or redistributed
  • Fraudulent activity is detected
  • These Terms are breached

11. Limitation of Liability

To the maximum extent permitted by law, Gainzville Training Club is not liable for:

  • Injuries
  • Losses
  • Indirect or consequential damages

arising from use of our Products or website.


12. Governing Law

These Terms are governed by the laws of Australia.


13. Online Coaching – Additional Terms

13.1 Nature of Online Coaching

Gainzville Training Club’s online coaching services are provided for educational, instructional, and guidance purposes only. Coaching does not constitute medical, physical therapy, or nutritional advice and does not replace consultation with qualified healthcare professionals.

13.2 Eligibility & Responsibility

By participating in online coaching, you confirm that:

  • You are physically capable of engaging in exercise and training activities
  • You will notify Gainzville Training Club of any injuries, medical conditions, or limitations
  • You accept full responsibility for your participation and decision-making

You agree to follow programs and guidance at your own discretion and to train within your personal limits.

13.3 Assumption of Risk

You acknowledge that physical training involves inherent risks, including but not limited to muscle strain, joint injury, illness, or other physical harm.

By engaging in online coaching services, you voluntarily assume all risks associated with participation, whether known or unknown.

13.4 Commitment & Payments

Online coaching requires a minimum commitment of 12 weeks unless otherwise stated in writing.

Payment options may include:

  • Weekly recurring payments
  • Upfront one-time payments for a fixed coaching period

All coaching payments are processed via third-party payment providers (e.g. Stripe).

Once coaching has commenced, payments are non-refundable, except as required by Australian Consumer Law.

13.5 Cancellations & Termination

Clients may request cancellation of coaching services by providing a minimum of 7 days’ notice prior to the next billing date.

Gainzville Training Club reserves the right to suspend or terminate coaching services without refund if:

  • Payments fail or are disputed
  • Terms are breached
  • Behaviour is abusive, inappropriate, or non-compliant
  • Continued coaching is deemed unsafe or unsuitable

13.6 Pauses & Missed Communication

Coaching services are delivered on an ongoing basis. Missed check-ins, delayed responses, or lack of communication from the client do not constitute grounds for refunds or extensions unless otherwise agreed in writing.

Any pauses or adjustments are granted at the sole discretion of Gainzville Training Club.

13.7 Results Disclaimer

Individual results vary. Gainzville Training Club makes no guarantees regarding outcomes, progress, or specific results from online coaching.

Results depend on factors including consistency, adherence, effort, recovery, and individual circumstances.

13.8 Limitation of Liability

To the maximum extent permitted by law, Gainzville Training Club is not liable for any injury, loss, or damage arising from participation in online coaching services.
